Terms of Service for Instrumentaly

1. Acceptance of Terms

By downloading, installing, or using the Instrumentaly mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Instrumentaly is a music practice application that helps users:

• Generate random musical notes and chords
• Practice with visual keyboard feedback
• Track practice progress (Premium feature)
• Detect pitch using device microphone (Premium feature)

The App is available in two versions:

• Trial Version: Free trial period with basic features
• Premium Version: One-time purchase unlocks advanced features

3. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device(s)
• Use the App for personal, non-commercial purposes

Restrictions

You may NOT:

• Reverse engineer, decompile, or disassemble the App
• Distribute, sell, or sublicense the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to circumvent Premium features without payment

4. Premium Purchase

One-Time Purchase

Premium features are unlocked via a one-time, non-recurring purchase of $4.99 USD (or equivalent in your local currency).

What's Included

Premium unlocks:

• Ad-free experience
• Advanced chord types (9th, 11th, 13th, sus2, sus4)
• Custom practice sets
• Dark mode theme
• Practice statistics and progress tracking
• Microphone-based pitch detection
• Time-to-identify tracking

Payment Processing

Payments are processed by:

• Google Play Billing (Android)
• Apple App Store In-App Purchase (iOS)

Your purchase is tied to your Google/Apple account.

Refunds

Refunds are handled by Google Play or Apple App Store according to their respective policies:

We do not process refunds directly. Contact Google or Apple for refund requests.

Restore Purchases

If you reinstall the App or change devices, you can restore your Premium purchase at no additional cost by tapping "Restore Purchases" in the App settings.

5. Free Trial (If Offered)

From time to time, we may offer a free trial of Premium features.

• Trial duration and terms will be clearly stated in the App
• You can cancel anytime during the trial without charge
• After the trial ends, you must purchase Premium to continue using Premium features

6. Free Trial

The Trial Version allows you to try Instrumentaly's basic features before purchasing Premium.

• Trial features are clearly indicated in the app
• No payment required during trial
• You can upgrade to Premium at any time

7. User Content

Instrumentaly does not collect or store user-generated content. All practice data remains on your device.

If we add cloud sync or social features in the future, these Terms will be updated.

8. Privacy

Your use of the App is also governed by our Privacy Policy.

Summary: We don't collect personal data. Your practice stays on your device.

9. Microphone Permission

If you enable microphone-based pitch detection (Premium feature):

• The App will request microphone access
• Audio is processed locally on your device for pitch detection
• No audio is recorded, stored, or transmitted
• You can revoke microphone permission anytime in device settings

10. Intellectual Property

All content in the App, including but not limited to:

• Code, design, graphics, logos, icons
• Musical chord/note data
• UI/UX design

is owned by Instrumentaly or its licensors and is protected by copyright and trademark laws.

11. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability

We do not guarantee that the App will:

• Be error-free or uninterrupted
• Meet your specific requirements
• Work with all devices or operating system versions

12. Limitation of Liability

To the fullest extent permitted by law, Instrumentaly shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or revenue
• Inability to use the App
• Device damage or malfunction

Maximum Liability: Our total liability shall not exceed the amount you paid for Premium (if applicable), or $10 USD if you use the Free Version.

13. Indemnification

You agree to indemnify and hold harmless Instrumentaly, its developers, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Violation of these Terms
• Violation of any third-party rights

14. Changes to the App

We reserve the right to:

• Modify, suspend, or discontinue the App (or any part of it) at any time
• Update features, remove features, or change pricing
• Release new versions with bug fixes or improvements

We will make reasonable efforts to notify you of significant changes.

15. Termination

By You

You may stop using the App at any time by uninstalling it.

By Us

We may terminate or suspend your access to the App if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or misuse the App

16. Third-Party Services

The App may integrate with third-party services (Google Play Billing, Apple App Store, Firebase).

We are not responsible for:

• Third-party service availability or performance
• Changes to third-party policies
• Data collected by third parties (see Privacy Policy)

17. Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict of law principles.

Any disputes shall be resolved in the courts of Portugal.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Instrumentaly regarding the App.
